TERMS AND CONDITIONS
General Provisions
Earthy Biome Private Limited (hereinafter "Be Clinical"), a Company incorporated under the provisions of the Companies Act, 1956 and having its registered office at 14, Navjeevan Vihar, Geetanjali Enclave, Malviya Nagar, Delhi-110017 offers its products for sale directly to its customers through this website www.be-clinical.com (hereinafter “Site”). The sale of Products on the Site is subject to these Terms and Conditions of Sale (hereinafter "Terms of Sale").
Information for Consumers
1. The Products displayed on the Site are offered for sale to consumers only (hereinafter “Consumer(s)” or "You"). The purchase of the Products on the Site is permitted only to individuals who are 16 years of age or over. The Products offered for sale on the Site can be purchased and shipped only to the locations/pin codes indicated on the Site.
2. Before confirming and submitting a purchase order, You must carefully read and accept these Terms of Sale. These Terms of Sale can be downloaded from the Site and/or requested via e-mail: hello@be-clinical.com. Be Clinical will send them to You pursuant to Article 3.5 below. We recommend that You print or electronically store a copy of the Terms of Sale, together with a copy of the Privacy Policy and the Information on the Right of Withdrawal, for Your future reference. These Terms of Sale, together with the Privacy Policy, contain the rules governing the contract between You and Be Clinical for the purchase of Products through the Site.
3. By submitting a purchase order, You hereby accept and undertake to observe, in the performance of the contract with Be Clinical, these Terms of Sale. If You do not agree with any of the terms set out in the Terms of Sale, You shall not submit the purchase order for the purchase of the Products on the Site.
Order Procedure and Acceptance
1. For each Product offered for sale on the Site, a picture of the Product will be displayed, together with the unit price, the colours, and sizes available. Pictures are provided purely to illustrate the Product. Be Clinical will not be responsible for any inadequate graphical representation of the Products offered.
2. To purchase a Product, You shall select the Product(s), the colour and the size. The selected Product(s) will be added to Your shopping bag. It will not be possible to save the shopping bag to proceed at a later stage. If the purchase procedure is not completed, all items in the cart will be deleted and You will need to start a new purchase procedure. The sales procedure is considered concluded only when the payment information has been confirmed. To submit the order, You will be required to provide personal data, including date of birth, payment details, and accept these Terms of Sale. You are invited to carefully review the summary of the essential characteristics of each Product ordered, the shipping costs, the conditions to exercise Your right of withdrawal, and the Privacy Policy.
3. It is possible to correct errors in the purchase process until submission of the order by following the Amendment Procedure indicated on the Site. Once the order is submitted, You will not be able to amend or cancel it.
4. After submission, Be Clinical will send You an email confirming receipt of the order and its processing (the "Acknowledgement Receipt"). Consumer orders will be stored in Be Clinical’s database located in Gurgaon for the necessary time. Consumers can access their orders by contacting Customer Services at +917042199965 or hello@be-clinical.com.
Please note that the Acknowledgement Receipt does not constitute acceptance of Your order. The order will be accepted and Your card debited only after the Products are ordered. At this point, Be Clinical will send an "Order Confirmation". A paper invoice will be included with the delivered Product.
Be Clinical reserves the right to refuse orders at its sole discretion, including from individuals not meeting order requirements, having ongoing disputes, or appearing to be dealers/distributors.
Availability
1. You are invited to check Product availability before purchase as Products may be subject to stock limits and Be Clinical does not guarantee constant availability.
2. In case of temporary unavailability, Be Clinical will inform You within 5 working days. If payment has been charged, a refund will be issued within 30 days.
Prices and Payment
1. Prices are in Indian Rupees (INR). Be Clinical is not responsible for any exchange rate discrepancies by Your bank.
2. While efforts are made to ensure price accuracy, errors may occur. If an error is discovered after the Acknowledgement Receipt but before Order Confirmation, Be Clinical will ask You to re-confirm or cancel the order. If You cannot be contacted, the order will be cancelled and a cancellation email sent.
3. Prices include GST except during discount periods. Shipping costs and other taxes will be itemized at checkout and in the invoice.
4. Payments accepted: Visa, Maestro, MasterCard, and e-wallets.
5. Products will be shipped only after credit card verification or payment authorization.
6. Products are supplied with an identification card. Do not remove this until You verify Product conformity or waive the right of withdrawal.
Delivery
1. Products are dispatched to the address provided during purchase. Orders will not be shipped to P.O. Boxes.
2. Deliveries are by selected couriers (e.g., DTDC, Safe Express), Monday to Friday excluding holidays.
3. Products will be delivered within 5 business days in metropolitan cities and within 10 business days in non-metropolitan areas. Be Clinical is not responsible for courier delays.
4. If Products are not received within 10 business days, contact hello@be-clinical.com. Complaints beyond 30 days from Order Confirmation will not be entertained.
Changes and Corrections
1. Be Clinical reserves the right to modify Terms of Sale, Privacy Policy, Product details and pricing at any time without notice. Please check them before each purchase.
2. Efforts are made to ensure accurate Product information, but typographical errors may occur. Be Clinical may correct errors, update information, revoke erroneous offers, or cancel orders prior to shipment.
If charged for a cancelled order, You will be informed and refunded within 30 days.
3. Changes apply only to subsequent orders unless otherwise decided by Be Clinical.
Conformity of Orders
1. Products must be checked at delivery to ensure they correspond to the order.
2. Any anomalies identified at the time of delivery — including but not limited to tampering or damage to packaging, damaged products, missing items (as per the transport document), non-conformity with the products ordered, or defective items (hereinafter referred to as “Defects”) — must be reported directly to Be Clinical by emailing hello@be-clinical.com. In such cases, the consumer is not obligated to accept the delivery.
3.If any Defects are identified after delivery, the consumer may return the product to Be Clinical by following the return procedure outlined in Section 10 below.
